In Workana, we believe that a good community has clear rules. Here are the policies for our website regarding different aspects of the platform. Keep in mind that this is a work in progress and, as we grow, Workana's rules will evolve too.
1. Behavior on the website
The comunication through messages should always be cordial. Abuse or insults will not be tolerated.
Workana does not allow any type of discrimination against people based on racial, ethnic, social, or minority origin, caste, religion or beliefs, political opinion or any other nature, language, gender, gender identity, sex, sexual orientation, disability, age, or any other condition. Neither Workana as a platform nor any user (client or professional) can commit any discriminatory practices mentioned above. Workana commits to sanctioning these actions if they are found to be committed.
Workana will be able to contact users through the instant messaging application WhatsApp, our representatives are identified with the identity of Workana. We do not ask for any payment, sharing of passwords or access data, if you suspect please contact support.
Do not share contact information (email, phone, skype, whatsapp, hangout, linkedin, instagram, facebook and external links in general)***
Sending an external link is not allowed . Nothing that makes a client and / or freelancer leave Workana's site. (including direct link from Behance should also not be sent).***
It is also not allowed to ask for contact details or an external link to another party.***
***This rule does not only apply to projects managed by Workana recruiters.
Respect the privacy of messages and Workana projects. What happens in Workana stays in Workana. Unless you have obtained written permission from the other party, you cannot make public any posts or content from the work.
Spam will not be accepted in any form. Remember that every time you spam, God kills a kitten.
Workana should not be used only as a payment method between freelancers and clients. Projects in which payments are released without communication between those involved and without deliveries that are related to the project, will not be accepted and the amounts will be returned to customers.
2. Site Content
You will not post projects, messages or content on the website about:
- pornography and content unsuitable for minors,
- violent content,
- content related to racial intolerance or attacks on a particular group or organization,
- content that includes excessive profanity,
- content related to hacking,
- content related to casinos and gambling,
- drug-related content and related articles,
- content related to the sale of weapons or ammunition (eg.: firearms, firearm components, knives or stun guns),
- content related to the sale of products that are replicas or imitations of designer goods and other items,
- malicious softwares (viruses, spyware, etc.),
- or any other content that is illegal, promotes illegal activity or infringes the legal rights of others.
3. Policies for the publication of projects
If a job is in violation of any of Workana's policies, it will be removed from the website. The client is free to re-publish the work if the violation is corrected.
The most common reasons for the removal of work ads on Workana are:
- It violates the terms of service of another company or entity.
- It asks vendors for unpaid work.
- The content violates section 2 of these policies.
- Payment is offered outside Workana's payment platform.
- Payment is based on commission or compensation in shares.
- The payment offered is less than the legal minimum wage in the professional's country
- It violates the integrity of an academic institution, including homework, writing essays for school, exams or submitting applications.
- It violates any U.S. laws or laws from any other country.
- It should not contain personal or contact information.
- It should not promote other services or products.
- It should not be used to find full-time employees.
3.1 Publishing Guide project
- The needs and skills required to complete the project must be clear.
- It must be written properly and completely.
- You must answer workers' questions and update the job description.
- Only accept proposals when you have a clear job description, well-defined milestones, exact timing and payment terms.
- Evaluate multiple proposals based on criteria that are important to you, experience as a worker, education, portfolio, certifications, references, feedback from previous clients, location, communication, style and cost.
- Ask the worker to establish the conditions, define milestones and payments.
- In case it is requested by the professional, the client must inform them of the purpose of the job they’re applying to.
- Ask about the worker's office hours and about their standard response times.
- Once you have hired someone for your project, log in to the site to manage their work.
4. Policies for Proposals
When submitting a proposal, the provider may not:
- Offer their services for free.
- Use unprofessional language and/or harass another member of Workana.
- Offer to get paid outside Workana.
- Make reference to the commission of the platform.
- Use messaging and proposals for other purposes instead of presenting a proposal.
- Include any contact information. For example: Skype, email, phone, website URL, GTalk, etc.
4.1 Guide to the publication of proposals
As a worker, you agree to follow these guidelines when submitting a proposal:
- Send proposals only for jobs for which you are a good option and are qualified to complete according to the deadline established by the Client.
- Help the client clarify their needs and fully develop the scope of work and deliverables.
- Write a concrete and detailed proposal with clear scope, deliverables and milestones.
- Set expectations that you can meet or exceed.
- Specify the payment terms that are linked to the achievement of milestones.
- Specify how requests for changes and revisions will be handled.
- Specify how the work guarantee will be handled.
- Submit a proposal accurately to reflect your understanding of the scope of work and of the amount of time / effort that you will dedicate in order to achieve customer satisfaction.
- Inform your client about your office hours and established response time.
- Submit a proposal again when necessary to reflect any changes in price, delivery date or approach, before the end of the period of proposal.
- Do not submit unreasonably low prices or "experimental" proposal or proposals. If you want to submit a proposal, but are in need of more information about the job, send a message to request more information, stating your assumptions about the scope of work on your proposal and explicit that the proposal will be updated once you receive more information.
- Do not send proposals with the intent to commit fraud.
- Do not present repetitive content or generic proposals.
- Do not offer your services in exchange for good feedback or for free.
5. Policies for posting your profile
A worker's profile cannot contain:
- Contact information beyond what is offered through Workana.
- Offers for payments outside Workana's payment platform.
- Offers for free services.
- Offers for services that are against Workana's Terms of Service or the policies of any other company or entity.
- Any text that is copied from another worker profile.
- Display of work over which the profile owner has no legal rights or property.
6. Policy about working relatioships in Workana.
Relatioships between employers and workers that starts in Workana must continue in Workana for at least 2 (two) years since the last completed project between the both.
Any work relationship that has started in Workana and continues outside the platform, loses our guarantee and put the user's account at risk. If this happens, Workana could close the accounts at any time.
7. Penalties for violation of a Policy
Workana will suspend or close the accounts of members who violate its policies.
- For publication violations offering jobs / projects, they will be removed from the site. Repeated violations of our policies will result in account termination.
- For workers' violations, the minimum penalty is a suspension of 15 days. For major violations, such as plagiarism, avoiding fee payments, manipulating comments or repeated violations of our policies, the worker's account is subject to immediate termination.
8. Criteria for arbitration resolutions
If the project cannot be completed, both the client and freelancer can request Workana's intervention through an arbitration (see Arbitrations). To make a fair decision, Workana takes the following factors into consideration:
- What was initially agreed upon between client and freelancer: The bid made by the freelancer and accepted by the client, the agreed-upon delivery times, the project scope, the delivery formats, and everything related to what was agreed to by both parties via Workana´s thread.
- Project development: The work done by the freelancer, the deliverables, the client's corrections, and all conversations that both parties had through the platform after the client makes the escrow deposit.
- Information provided by both parties: Once the project begins the arbitration process, both parties are asked to inform Workana about the work done and the information they deem appropriate to emphasize.
Taking all these aspects into account, Workana will analyze all the information and decide about the destination of the funds in guarantee and the ownership of the work done.
It is important to clarify that any conversation outside the platform, or work developed that does not have support within the platform, will not be valid to determine the resolution of the arbitration.
In the event of a disagreement with Workana's decision in arbitration, either party may appeal to a third party through binding arbitration to the American Arbitration Association (“AAA”) in the city of Miami, Florida, pursuant to the current business rules for the AAA, except as provided here in (the “AAA Rules”).
The party wishing to initiate arbitration must send the other party a Request for Arbitration in writing, as specified in the AAA Rules. (The AAA offers a form called the “Demand for Arbitration”
